KeyMail Terms of Service and Software License Agreement
IMPORTANT! Please read carefully: Before installing or attempting to use this software, it is important that you read and understand the terms of this License Agreement.
Specialized Business Solutions (“SBS”), a California corporation, is the developer, publisher and owner of Keystroke and other computer software programs (“Software”). SBS grants certain licensees the right to use its software programs under the terms of this Software License Agreement. To use Keystroke or any other software published by SBS, you must agree to the terms of this Agreement, and by installing or accepting an electronic license activation (e.g., License Key, Product ID Code, any type of license registration), you are explicitly agreeing to the terms of this Agreement.
SBS grants the licensee the right to use the licensed software in the operation of a single business entity; where a “business entity” is defined as a place of doing business (such as, but not limited to, a storefront, office, or warehouse), or a unique commercial business differentiated by business name, advertising, or signage (physical or electronic) which may be perceived by the public as a separate business. A separate software license identified by a unique Serial Number must be purchased for each separate business entity using the software regardless of the technology used to access the software. SBS reserves the right to determine licensing requirements for any use of its software. Keystroke and other computer software programs are owned by SBS and are protected by United States and international copyright laws. Therefore, no part of the software or accompanying documents may be reproduced or transmitted in any form or by any means (electronic, mechanical, magnetic, or otherwise) without the written permission of SBS.
SBS makes no warranties implied or inferred with respect to this software, the accompanying documents, and any accompanying hardware. Further, SBS reserves the right to change the information in this software or accompanying documents without notice. SBS shall not be liable for errors contained herein or for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of
business information, or other pecuniary loss) resulting from the use of or inability to use this product. Any and all disputes arising out of or related in any way to this License Agreement shall be resolved through arbitration procedures, as recommended by the American Arbitration Association, in Long Beach, California.
